How family mediation works

Mediation is a structured conversation with a neutral person in the room. Here is what to expect from the first call to a written agreement.

  1. First contact

    One of you calls or emails. Frank explains how mediation works, answers questions and, with your permission, contacts the other person to invite them in.

  2. Individual intake meetings

    Frank meets each of you separately. This is where he learns the issues from your side and screens for family violence or power imbalance, so he can confirm mediation is safe and fair.

  3. Agreement to mediate

    You both sign an agreement to mediate. It sets out the fee, confidentiality, and the rule that each of you can end the process at any time.

  4. Financial disclosure

    If support or property is on the table, you each exchange financial information, such as tax returns and a financial statement, so decisions rest on real numbers.

  5. Joint sessions

    You meet together with Frank, in person or by Zoom, usually for two to three hours at a time. If being in the same room is hard, Frank can shuttle between separate rooms.

  6. Memorandum of understanding

    Frank writes up what you agreed. Each of you reviews it with your own lawyer, who can turn it into a binding separation agreement or consent order.

In-person sessions

Available anywhere within 100 km of Hamilton, Ontario. Sessions take place in a private meeting space agreed with both of you.

Zoom sessions

Available anywhere. You need a computer or tablet with a camera and a private space. Zoom breakout rooms let Frank meet each of you alone during a session when that helps.
